Storage Tank Limited Warranty Policy
Purpose
This document sets out the Company’s policy with regard to the Warranty against defective materials and workmanship on storage tanks manufactured and delivered by Forgeweld Engineering (Pty) Ltd.
Warranty
All storage tanks manufactured by Forgeweld Engineering (Pty) Ltd shall carry a Warranty against defective materials and workmanship for a period of twenty four (24) months from the date of installation.
Warranty Conditions
- Tank installations must be carried out in compliance with SANS 10089-3.
- The tank must be installed by a recognized installations expert.
- This Warranty is limited to the original installation.
- Forgeweld must be notified immediately that a problem is identified with the tank.
- Forgeweld must be given the opportunity to inspect the tank prior to any action being taken to evacuate the tank.
- The original installation documentation must be made available to Forgeweld.
Warranty Limitation
- Forgeweld obligation under this Warranty shall be limited to the extent but only to the extent that Forgeweld can demonstrate that a defect resulted from:
- Unauthorized alteration, modification or repair;
- Improper handling, storage, operation, interconnection or installation;
- Failure to maintain and care for the product in accordance with industry best practice or the suppliers reasonable directives.
- In no event shall Forgeweld be liable for any consequential damage, punitive damages, exemplary damages, loss of profits or loss of opportunity which may be suffered by the purchaser in connection with the damage identified.
Forgeweld liability in respect of any defect identified shall not exceed the value of the actual product or service delivered, manufactured or rendered to which the Claim relates.
